In China, one trademark application covers one mark (word, designed logo, sound and 3D object) in one particular Class. China follows the Nice Classification of Goods and Services.

China employs a “first to file” system for trademark registration. Unregistered trademarks are offered with very limited protection. Moreover, you run the risks of your trademarks being squatted by someone else who can block you from using your trademark. Even if you are only manufacturing products (OEM) and not selling them, you must register your trademarks.

      What's included in the service package? Expand

      Trademark application package is a flat fee service which encompasses trademark search, application preparation, filing, reporting, and deliver registration certificate.

      After a trademark search, we will offer some detailed advice as to what classes to apply and the generally successful rate.

      It does not include response to objections filed by a third party or any subsequent appeal procedures.

      Is there any refund policy? Expand

      Yes, we do. If a trademark search reveals that your mark is absolutely not possible to register in China, we will refund the entire fee. However, once we file the application, the entire fee is not refundable.

      What can be trademarked and what cannot? Expand

      Word, design, letter, numeral, three-dimensional symbol, a combination of colors, and sound, as well as a combination of the above, may serve as a trademark for registration purposes. However, ideas, complex artistic work, and software are not eligible for trademark registration.

      Who can be the applicant? Expand

      Any natural person or entity can be the trademark applicant in China. Such person and entity should have complete control over the existence of a trademark. The name should be on the passport (in case of a natural person) or on the certificate of incorporation (in case of legal entity).

      How long does it take to register a trademark? Expand

      The China Trademark Office will have to make a judgment whether a trademark can be registered within 9 months of receiving the application. But in practice, it is advised to budget one year because there may be office actions or other communications involved.

      How long does a trademark registration last? Expand

      The initial period of validity of a registered trademark is 10 years, from the date of approval of the registration. For renewal, the period of validity of each renewal is 10 years, counted from the day immediately following the expiration of the prior validity period.

      If the registrant intends to continue to use the registered trademark beyond the expiration of the validity period, it should submit a renewal application within six months before the expiration date. If no application is filed within this period, a grace period of six months is granted. If no application is filed at the expiration of the grace period, the registered trademark will be removed from the registrar and anyone else can register the mark.
