Service Invention Regulation draft published for comment in China

On April 2, 2015, the State Government of China has published a draft of Service Invention Regulation (“Draft”)for public comment, and the deadline for accepting comment is May 2, 2015.

The State Government intends to stimulate creativeness of investors and protect the inventor’s interest and benefit from their inventions and to enhance the IP management by companies.

The Draft details the definition of service invention and advises companies to implement service invention reporting and management policies internally. The Draft highlights the method for calculating compensation and award for inventors.

You may download a Chinese copy of the Draft here. Since the Service Invention Regulation has not been promulgated, we will give a full analysis later. Stay tuned.
